12A/80G Online Registration Guide: Criteria, Process, and Fees

Registration under Sections 12A and 80G of the Income Tax Act offers dual benefits to NGOs:

  • 12A Registration: Grants exemption of the organisation’s income from Income Tax.

  • 80G Registration: Allows donors to the NGO to claim tax deductions on their contributions.

Applications for 12AB and 80G registration can be made either jointly or separately. However, if applied separately, registration under 12AB must be obtained first, as it is a mandatory prerequisite for 80G registration under the Income Tax Act, 1961.

Basic Requirements for 12A and 80G Registration

Minimum Requirements for 12A & 80G Registration

  • The organization must be a registered NGO.

  • Application for registration under Section 80G can be made only after obtaining registration under Section 12A.

  • The NGO should not have any income generated from commercial or business activities.

  • The organisation must maintain proper books of accounts reflecting receipts and expenses.

  • Registration Certificate and Memorandum of Association (MoA) in case of a Section 8 Company

  • Trust Deed in case of a Trust

  • Proof of registered address of the organisation

  • Copy of utility bills such as electricity or water bills

  • Books of accounts for the past three years (or since inception, if newer)

  • Activity reports and progress/project reports for the past three years

  • List of donors with complete details

  • Bank account statements for the last three years

Processing Timeline

  • Application filing: Within 5–10 days

  • Approval by the Jurisdictional Principal Commissioner: 20–30 days

Steps for 12A Certificate Registration

  1. Application Submission: The application for 12A registration is to be filed online using Form 10A on the Income Tax Department’s e-filing portal (www.incometaxindiaefiling.gov.in).

  2. Form Access: Form 10A can be accessed under the “Income Tax Forms” section of the website, available through the e-file menu after logging into the portal.

  3. Verification by Commissioner: Once the application is submitted, the Commissioner reviews the documents and assesses the genuineness of the NGO’s activities. If required, the Commissioner may request additional documents or information.

  4. Order of Registration: After due verification, the Commissioner passes a written order. If satisfied, the NGO is granted 12A registration. If not, the application may be rejected, but the applicant will be given a fair opportunity to present their case before rejection.

80G Registration Guidelines

Steps for 80G Certificate Registration

  1. Application Submission: The application for 80G registration is filed in Form 10G, along with the required documents, to the Jurisdictional Principal Commissioner or the Commissioner of Income Tax (Exemptions).

  2. Verification Process: Upon receiving the application, the Commissioner examines the documents and assesses the genuineness of the NGO’s activities. If needed, the Commissioner may request additional documents or information.

  3. Order by Commissioner: After verification, the Commissioner issues a written order. If the application is approved, the NGO is granted 80G registration. If the Commissioner is not satisfied, the application may be rejected. However, the applicant will be given a fair opportunity of being heard before any rejection.
